Our Practice

We work with injured individuals and with their attorneys, offering legal counsel and expert testimony in matters involving Workers' compensation hearings and appeals, settlement negotiations and the drafting of settlement documents, and Social Security Disability hearings and appeals. In addition our law office provides document preparation and analysis services in both Medicare Set-aside analysis, as well as, preparation of workers' compensation settlement documents including full submissions to The Centers for Medicare & Medicaid Services.

  • Settlement Document Preparation. If you settle a workers' compensation claim your settlement documents must contain Social Security disability and Medicare provisions so that these important collateral benefits are not jeopardized by the settlement of your claim. preparation of workers' compensation settlement documents to see the DIB worksheet.
  • Medicare Set-Asides. If you have received or are about to receive a settlement for a workers' compensation or personal injury claim, we can help you make certain that the settlement agreement contains language that protects your right to receive Medicare benefits. We will work to minimize the amount you will be required to set aside to comply with current regulatory requirements. Medicare Set-aside analysis to see the MSA worksheet.
  • Medicare Conditional Payments: If your client is currently a Medicare beneficiary or has been a Medicare beneficiary in the past investigation of any Medicare conditional payments must be made. We provide both investigation and reconciliation services. For more information go to the Medicare Conditional Payments.
  • Social Security offsets. We negotiate and draft language for clients and other attorneys that mitigates or eliminates, if possible, the adverse impact of offset provisions that can significantly reduce important monthly Social Security Disability benefits  when you receive workers' compensation or other remuneration.

Because of our extensive knowledge and experience, we are often called on by other lawyers to prepare legal opinion letters or to provide expert testimony on matters involving workers' compensation claims, Medicare Set-Asides or Social Security offsets. We provide these services on a broad range of issues, including the value of a case, the legal issues involved and matters of causation or insurance liability. For more information, go to our page on expert testimony services and legal opinion letters.

We have also developed a software program, called MSA Fast Draft Pro, to assist legal professionals with the preparation of Medicare Set-Aside provisions, Social Security offset, as well as Medicare and other lien resolution issues in settlement agreements.
